1. Acceptance of these terms
By downloading, installing, creating an account, or otherwise using Consiq (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and Consiq.
2. Eligibility
You must be at least 13 years old (or 16 where required by local law) to create an account. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these terms on your behalf. The Service is not intended for anyone prohibited from using it under applicable law.
3. Your account
You are responsible for keeping your login credentials secure and for any activity that happens under your account. Notify support@consiq.app immediately if you suspect unauthorized access. One account per person; you may not share accounts.
4. Your content and conduct
You retain ownership of the content you post. You grant Consiq a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit that content solely to operate the Service (for example, showing your proof upload to your pod). You are responsible for your content. Do not post content that is illegal, infringing, hateful, harassing, sexually explicit, involves minors inappropriately, promotes self-harm, or violates any person’s privacy. Do not impersonate others or misrepresent your affiliation. We may remove content or suspend accounts that break these rules.
5. Acceptable use
Do not (a) reverse engineer, decompile, or attempt to extract source code from the app; (b) abuse the API or attempt to overload our systems; (c) scrape, harvest, or systematically download pod content; (d) bypass moderation or rate limits; (e) use the Service to build a competing product; (f) upload malware or engage in phishing. We may suspend or terminate accounts for any violation.
6. Premium subscription and in-app purchases
Consiq offers a paid Premium plan. Subscriptions are sold through Google Play and the Apple App Store and are governed by the applicable store’s billing terms. Payment is charged to your store account at confirmation of purchase and auto-renews at the end of each billing period unless cancelled at least 24 hours before renewal. Manage or cancel your subscription in your Google Play or App Store account settings — cancellations take effect at the end of the current billing period; we do not pro-rate mid-period cancellations. Prices may change; we will give at least 30 days’ notice before a price increase affects you.
7. Refunds
Because subscriptions are billed by Google Play and Apple, refund requests are handled by them under their policies (Google Play refund policy / Apple report-a-problem). Where required by law (for example, the EU right of withdrawal), you may be entitled to a refund from the applicable store. If you believe you were charged in error and cannot resolve it with the store, email support@consiq.app and we will do our best to help.
8. Free trials and promotions
If we offer a free trial, we will disclose the trial length and the renewal price before you start it. Your paid subscription begins automatically at the end of the trial unless you cancel before it ends.
9. Termination
You may delete your account at any time from Me → Account Settings → Delete account, or by following the steps at /delete-account. We may suspend or terminate your account if you materially breach these terms, if we are required to by law, or if we discontinue the Service. On termination, your right to use the Service ends immediately; the sections of these terms that by their nature should survive (ownership, disclaimers, liability, dispute resolution) will survive.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, secure, or meet your particular goals. Consiq is not a medical, mental-health, legal, or financial service. Nothing in the app is professional advice, and you should not rely on it as such.
11. Limitation of liability
To the maximum extent permitted by law, in no event will Consiq be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, however caused. Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) fifty US dollars ($50). Some jurisdictions do not allow these limits; in that case, they apply to the fullest extent permitted.
12. Indemnification
You agree to indemnify and hold Consiq harmless from any claim, damage, or expense arising from your content, your use of the Service, or your violation of these terms.
13. Third-party stores and services
The mobile app is distributed through Google Play and the Apple App Store. Your download and use of the app is also subject to those platforms’ terms. In the event of a conflict between those terms and these terms, the platform’s terms control for platform-specific matters (installation, billing, refunds).
14. Governing law and disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction. Nothing in this section restricts consumer rights that cannot be waived under the law of your country of residence.
15. Changes to these terms
We may update these terms. If a change is material, we will give at least 30 days’ notice in the app or by email. Continued use of the Service after the effective date means you accept the change. If you do not accept, you should stop using the Service and may delete your account.
